New law extends protection term of phonograms and interpretations from 50 to 70 years
The Law regarding the inclusion of Section 5 bis in Law 11723 on Intellectual Property has been approved last November 25th. This new law extends protection terms of phonograms and interpretations from 50 to 70 years as beginning with their publication.
The object of this inclusion consists in improving the ownership of musical production and broadening the rights of interpreters and record companies over their interpretations and phonograms, locally and worldwide.
The draft bill has a retroactive effect as it states that:
those phonograms and interpretations in public domain prior to the provided protection terms shall return to private domain for the remaining period, i.e. third parties shall cease any form of use carried out during said term of public domain.
